Please join us on Thursday, 29 August 2024 at 5pm AEST for a discussion on indirect liability for IP infringement.

 

This seminar will consider:

 

  • the current state of Australian law on copyright infringement by authorisation, with a focus on the High Court decision in the Real Estate Tool Box v Campaigntrack case; and
  • the way the Full Court dealt with liability and remedies for trade mark infringement in the most recent Hells Angels v Redbubble case, as compared to earlier cases involving the Redbubble online marketplace.

 

Our speakers are Emma Bathurst, Luke Hawthorne and Joel Barrett.

 

Emma Bathurst is a barrister at Fifth Floor St James' Hall, and has been recognised in Chambers Global Guide (2021) and in Doyle's Guide as an intellectual property junior counsel (2018-2019). Emma has an extensive practice across commercial and intellectual property law, and appeared for Redbubble in the copyright and trade mark infringement cases brought by Hells Angels.

 

Luke Hawthorne is a senior associate at King & Wood Mallesons and works across intellectual property, technology and regulatory disputes. His copyright experience includes advising some of the world’s leading technology companies and digital platforms on intermediary liability, copyright strategy, enforcement, and law reform.

 

Joel Barrett is a Partner in the Intellectual Property group at Allens, with a particular focus on IP issues in technology, e-commerce, software development and new media.  He also sits on the Management Committee of the Copyright Society of Australia, and has been recognised by Managing Intellectual Property's IP Stars as a Notable Practitioner and by IAM's Patent 1000 as an 'ambidextrous IP lawyer [who] matches abundant IP disputes know-how with keen commercialisation acumen'. Joel has acted for Redbubble in all of its Australian IP litigation.
